Chairman Dalton called the meeting to order at 7:00 p.m. He announced that the meeting will be recorded for cable television transmission and left those in attendance in the Pledge of Allegiance.

 

Approval of state election warrant

Town Clerk Trudy Reid provided the November state election warrant for approval.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the November 2018 State Election warrant as presented. Vote was unanimous

 

Appointment of election worker

Town Clerk Trudy Reid has recommended the appointment of Ann Bankoff as an election worker.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen appoint Ann Bankoff as an election worker for a term ending on June 30, 2019. Vote was unanimous.

 

Amusement license application, Kings, Market Street

Kings is seeking to add 55 electronic games to its Market Street location, while removing billiard tables and restaurant seating. Kings was represented by attorney Mark Vaughn of Reimer and Braunstein and will present the plan for the Board’s approval. In response to questions from the Board, he said the games would go against a back wall and would replace three billiard tables and restaurant seating. He said the games are air hockey and traditional arcade games such as Mario Kart and Golden Tree.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the application of King’s, Market Street, for an amended automatic amusement device license for 55 coin-operated games as presented. Vote was unanimous.

 

Change of officer/director application, Legal C Bar, Market Street

Legal Sea Food, Inc., doing business as Legal C Bar, is seeking to amend its liquor license to reflect a change in officers. This affects all Legal Sea Foods, Inc. restaurants throughout the Commonwealth and the application has been pre-approved by the state Alcoholic Beverage Control Commission. Local approval is still required.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the application for a change of officer/director for Legal Sea Foods, Inc., doing business as Legal C Bar, Market Street, as presented. Vote was unanimous.

 

Proposed changes in unit pricing, LIFE, Inc.

LIFE, Inc. has submitted a proposal to increase the unit sale prices for its three housing developments. H. Joseph Maney and Salvatore Yerardi of the of LIFE, Inc. Board of Directors were on hand to explain the rationale and sale price history.

 

Mr. Maney said that LIFE generally changes prices of units every three to five years. The last change was three years ago. This proposal calls for a 6.12 percent increase in sales process for all units, which is equal to a compounded increase of two percent over each of the last three years.

 

Mr. Yerardi told the Board that when a unit is sold, the seller and LIFE, Inc. split the difference in the price when the unit was purchased by the owner and the current sale price. LIFE uses its share of the funds to upgrade units. The LIFE Board looked at comparable values at rates of appreciation for Lynnfield condominium complex at Partridge Lane and Pyburn Road, as well as condominium complexes in Peabody, Reading, North Reading and Wakefield. This will be the first requested change in pricing for the Colonial Village units.

 

Mr. Maney explained that the Board’s approval is required as it is the Class A Shareholder in LIFE, Inc. and that LIFE, Inc’s bylaws requires this approval.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the proposed changes in unit pricing for LIFE, Inc. housing developments as presented. Vote was unanimous

 

Veterans dedicated parking space, Town Hall lot

Veterans Services Director Bruce Siegel is proposing that the Town create a designated parking space for veterans in the upper Town Hall lot close to the side entrance. He said this is just another way to recognize the contributions of veterans. Board members thanked him for bringing this proposal forward.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen direct the Department of Public Works to post as “Veterans Parking Only” a space adjacent to the handicapped parking spaces at the upper Town Hall lot. Vote was unanimous.

 

Appointment of Director of Planning and Conservation

Town Administrator Robert Dolan explained that town meeting appropriated $65,000 for a salary for a Town Planner, replacing the Planning and Land Use Administrator position. While considering staffing models and options, it was proposed that Emilie Cademartori, the current Conservation Administrator, who previously served as a Planning Director in Wenham, oversee both Planning and Conservation operations in a combined position. The Planning Board and the Conservation Commission have approved a proposal to combine staff positions for their departments and create the position of Director of Planning and Conservation. Under the Town Charter, the Board of Selectmen appoints a Planning Director. Ms. Cademartori developed a staffing proposal that would not require any funding beyond that appropriated at town meeting. The new department would include one full-time director and two union part-time clerical workers, one primarily concentrating on planning issues and the other on conservation issues.

 

Mr. Dolan said Ms. Cademartori has received accolades for her contributions from citizens, local attorneys, and Town employees and committee members.

 

Chairman Dalton said Ms. Cademartori has already made an impact at Town Hall and said he strongly endorses this plan. Selectmen Crawford and Barrett agreed.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen appoint Emilie Cademartori as Director of Planning and Conservation. Vote was unanimous.

 

Town Meeting Study Committee Report

Chairman Jack Adelson and members of the Town Meeting Study Committee appeared before the Board to discuss the recommendations of their committee. They have proposed several warrant articles, which are included in the proposed warrant.

 

Mr. Adelson introduced his fellow committee members. He said that the results of the survey conducted by the committee, which received 1300 responses, has been posted on the Town’s website. He said the responses indicated that residents wanted shorter meetings, electronic voting and check-in, and no change to the quorum requirement. He said the committee was informed by voluminous research provided on the town meeting operations of other communities, provided by Moderator Arthur Bourque. He noted Town Clerk Trudy Reid also serves as Moderator in Wenham. Committee members attended town meetings in North Reading, Rockport, Ipswich and Wayland. Several of them made significant use of technology. Some include projections of the recommendations of Town committees on each article. Incorporating such changes may require earlier deadlines.

 

After several meetings, the committee is bringing forward three proposed warrant articles, all of which would change the Town’s bylaws.

 

The first would limit formal presentations to 10 minutes unless a longer period is approved by a vote of the meeting. This would include one presentation in favor and one presentation in opposition to each article.

 

The second would limit the time of speakers on the floor to three minutes, and each speaker could not address an article more than twice, unless answering an inquiry. A vote of the meeting could waive these requirements.

 

A third would require that town meetings start no earlier than 7:00 p.m. and that no article be introduced after 10:30 p.m. unless the meeting votes to hear and act on it.

 

A fourth would bar the reconsideration of any article unless the moderator ruled that there had been a significant error made, or that new information had come forward following the vote. The motion for reconsideration would have to site the reason. This change would eliminate the need for the confusing parliamentary move of moving reconsideration in the hope that it would fail, which is employed to keep residents who were in the minority from bringing the article once again up for a vote when members of the meeting had left or at a different session of town meeting, hoping for a different result.

 

Selectman Crawford thanked Mr. Adelson and the committee and said he believes these proposals will help streamline town meeting. He noted that in each case, the voters can choose to make an exception. Selectman Barrett thanked Moderator Arthur Bourque for suggesting the formation of this committee.

 

Set public hearing for the laying out of Parsons Avenue Ext. as a public way

Parsons Avenue Extension was developed as a subdivision and according to Town Engineer Charlie Richter it has met all the requirements for acceptance as a public way. The Board must hold a hearing on the laying out of the way as a precursor to action by town meeting to accept the way.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen hold a public hearing on the laying out of Parsons Avenue Ext. as a public way on Wednesday, October 10, 2018 at 7:45 p.m. at the Merritt Center, Market Street. Vote was unanimous.

 

Close town meeting warrant

The fall town meeting will be held on Monday, October 15, at 7:00 p.m. at the Middle School auditorium. Town officials and boards have been working on several warrant articles.

 

Assistant Town Administrator Robert Curtin provided a brief explanation of the warrant articles, which are listed below:

“Any person who wishes to offer the principal presentation in support of the main motion under an article must so notify the Moderator prior to the session at which the article is called.  Unless granted an extension of time by vote of the meeting, the individual speaking as the principal proponent on a main motion shall not speak for more than ten (10) minutes.  If more than one person indicates a desire to make a presentation in support of the article, the Moderator may divide the time.  The same rules will apply should there be a principal speaker in opposition.”

“Each session of a Town Meeting required by Section 2-3-1 or Section 2-3-2 of the Charter or of a Special Town Meeting shall begin no earlier than 7:00 PM, and no such session shall conclude later than 10:30 PM unless at such hour a deliberation and / or vote is in progress in which event action under the article shall be completed prior to adjournment.  No consideration of an article shall be commenced after 10:30 PM unless the meeting votes to hear and act upon such article notwithstanding the hour, or votes to postpone adjournment to a specific, later time, or votes to defer adjournment until all warrant articles have been acted upon.”

ARTICLE 8. To see if the Town will vote to amend the General Bylaws by adopting the following as Article IV, § 45-8 of Chapter 45:
 

Ҥ 45-8 Reconsideration.

 

“When final action has been taken under an article and the meeting has taken up the next order of business, or adjourned, the subject matter of such article may not again be taken under consideration unless, in the discretion of the Moderator, a significant error or omission occurred in connection with the meeting’s action under that article, or a significant change in circumstances has occurred, such that there is a substantial likelihood that the outcome could change upon reconsideration or that reconsideration is in the Town’s best interest. 

 

“Upon a motion and second for reconsideration, the Moderator shall ask the maker of the motion to state the circumstances necessitating reconsideration.  If, in the opinion of the Moderator, reconsideration meets the criteria established in the above paragraph, the Moderator shall so state and the meeting shall proceed without debate to a majority vote on the motion for reconsideration.”

“B.  Notice of every other Town Meeting, including that required by Section 2-3-2 of the Charter, shall be given by posting a copy of the Warrant calling the same in compliance with MGL c. 30A, § 20, and in at least six public places in the Town, and such other places as the Selectmen may designate, at least 14 days before the time of the holding of said meeting.”

ARTICLE 10. To see if the Town will vote to amend the Re-codified Zoning Bylaw by restoring certain provisions that were inadvertently omitted in the process of re-codification, specifically:

 

1.         by adding, as § 4.1.3, the following:

 

            “4.1.3  Building Heights.  In all districts, no building shall be constructed to exceed more than three (3) stories or forty (40) feet in height, the height in each case to be measured vertically from the average finished grade of the ground adjoining such building to the highest point of the roof for flat roofs, to the deck line for mansard roofs, and to the average height between eaves and ridge for gable, hip and gambrel roofs.  Provided, however, in a Commercial District and in a Limited Industrial District, the height of a building may exceed forty (40) feet by one foot for each additional foot by which:

 

                        1.         the front yard depth exceeds the depth herein required, or

 

2.         the narrower side yard exceeds the side yard width herein required, or

 

3.         the rear yard exceeds the rear yard depth herein required, whichever of the three additional distances is the smallest.

 

A building thus permitted to exceed forty (40) feet in height may be constructed to contain more than three (3) stories, but no such building shall in any case have a height greater than fifty (50) feet.”; and

 

2.         by adding, at the end of footnote 2 in the Table of Dimensional and Density Regulations in § 4.1.2, the words “40 feet.”; and

 

3.         by adding, after the date “1996” in § 2.3.1, the following: “and ‘Additional Groundwater Protection District Lynnfield, MA August 25, 2009,’”; and

 

4.         by deleting the five stray asterisks (“*****”) that appear in the first line of the Table of Use Regulations, Appendix A;

ARTICLE 11. To see if the Town will vote to adopt as Chapter 197 of the General Bylaws the following:

 

“Chapter 197.  Security Posted in Connection With Licenses, Permits & Approvals

 

            “Article I.  Purpose and Authority

 

“§ 197-1.  The purpose of this Bylaw is to provide a mechanism for the application by Town officers, boards, committees and commissions of security posted by applicants in connection with their obtaining licenses, permits, approvals, authorizations and contracts.  This Bylaw is adopted pursuant to the home rule authority of the Town and the authority conferred by G.L. c. 44, § 53G1/2. 

 

            “Article II.  Scope

 

“§ 197-2.  It is the intent of this Bylaw to govern as broad a range of situations as possible in which Town officers, boards, committees and commissions require some form of security from applicants, provided only that this Bylaw shall not apply to deposits or other financial surety received under G.L. c. 41, § 81U.  Without limiting the generality of the foregoing, this Bylaw shall apply to surety required by (a) the Board of Selectmen to secure performance under any contract which such board is authorized to execute by general or special law or by any of the General Bylaws; (b) the Board of Selectmen to secure performance of any condition for the issuance by such board of any license, permit or approval including, without limitation, a street opening permit under § 217-7 or drain connection permit under § 217-7 of the General Bylaws; and (c) the Conservation Commission to secure performance of any obligation undertaken by an applicant for an order of conditions or other approval granted by such commission including, without limitation, under § 240-9 of the General Bylaws.

 

            “Article III.  Form and Handling of Surety

 

“§ 197-3.  Subject to any restrictions set forth in any authorizing statute or Bylaw, Town officers, boards, committees and commissions may require, accept, hold and apply security in any reasonable form including, but not limited to, a deposit of money or negotiable securities, a bond issued by a bonding company authorized to do business within the Commonwealth of Massachusetts, a letter of credit, and a so-called ‘tri-partite’ agreement of the kind described in G.L. c. 41, § 81U(4).

 

“§ 197-4.  Any deposit of money hereunder shall be held by the Treasurer in a special account established specifically for such purpose, separate and apart from all other funds.  Any negotiable securities, bonds, letters of credit and so-called ‘tri-partite’ agreements shall also be held by the Treasurer, and any funds generated from such surety shall likewise be deposited in such a special account.  Any such account shall be an interest-bearing account with a Massachusetts bank.  All interest accruing on each such account shall be added to the principal of such account for disposition as set forth herein.

 

            “Article IV.  Performance Standards

 

“§ 197-5.   Any Town officer, board, committee or commission demanding surety from any applicant hereunder shall be responsible for determining, in the exercise of his or its reasonable discretion and in good faith, the extent, quality and adequacy of any work done by such applicant or performance by such applicant of the obligation for which such surety was given.  Such officer, board, committee or commission may, but need not, reduce the amount of surety held upon proof of satisfactory partial work or performance by such applicant, provided that nothing herein shall require that such reduction be commensurate with the extent of such performance.

 

“§ 197-6.  If and when such Town officer, board, committee or commission determines that such applicant has fully and satisfactorily completed all work and performed all obligations for which such surety was given, such surety shall be released and returned to the applicant, including any accrued interest.

 

            “Article V.  Default

 

“§ 197-7.  If any Town officer, board, committee or commission which has received surety for work or for the performance of any obligation hereunder determines at any time that the applicant who posted such security is in default of his, her or its obligations (whether because of a failure to complete such work or performance by a designated deadline, or the unsatisfactory quality of such applicant’s work or performance, or otherwise), such officer, board, committee or commission may declare such applicant in default.

 

“§ 197-8.  Upon a declaration of default, such officer, board, committee or commission shall be entitled to apply any and all surety posted by such applicant (including any interest received thereon) to the completion of the work or the performance of the obligations for which such surety was posted.  Without limiting the generality of the foregoing, such officer, board, committee or commission may take any and all actions necessary or appropriate to enforce any bond, make demand on any issuer of a letter of credit, and demand payment under any so-called ‘tri-partite’ agreement, and any money received as a result thereof shall be deposited in an account held by the Treasurer under § 197-4, above.  Monies in such special account may be expended by such officer, board, committee or commission, without further appropriation, to complete the work or perform the obligations which such applicant was obliged to do or perform.  Any monies remaining in such account after all work has been done and all obligations performed to the full satisfaction of such officer, board, committee or commission shall be returned to the applicant, including any accrued interest.

 

            “Article VI.  Procedure for Return of Surety

 

“§ 197-9.  At any time, and from time to time, an applicant whose surety is being held by the Treasurer on behalf of a Town officer, board, committee or commission may give written notice to such officer, board, committee or commission that in such applicant’s opinion the work or performance that such surety was intended to secure has been fully and satisfactorily completed.  Such notice shall contain a demand for the return of surety and the full name and address of the applicant.  If such officer, board, committee or commission determines that such work or performance has been fully and satisfactorily completed, then he, she or it shall release the surety, or so much of it as may then remain, including any accrued interest, as set forth in § 197-6, above.  If such officer, board, committee or commission determines that such work or performance has not been fully and satisfactorily completed, then he, she or it shall specify in a written notice to the applicant the details wherein such work or performance remains incomplete or unsatisfactory within forty-five (45) days after the receipt by such officer, board, committee or commission of the said notice and demand from the applicant.  In the event that such forty-five- (45-) day period expires without such specification, then the applicant shall be entitled to the return of all surety then remaining, including any accrued interest.  Any notice under this Bylaw by an applicant to a Town officer, board, committee or commission shall be given by certified mail, return receipt requested, and shall not otherwise be effective.

 

“§ 197-10.  If any applicant appeals from an act or omission of any Town officer, board, committee or commission hereunder, whether by means of an action in the nature of mandamus or certiorari or otherwise, and such action results in a judgment in favor of such officer, board, committee or commission, then the latter’s reasonable attorneys’ fees and expenses incurred in defense against such action may be reimbursed from the surety posted by such applicant. 

 

            “Article VII.  Severability

 

“§ 197-11.  If any term, condition or provision set forth in this Bylaw should be found by a court of competent jurisdiction to be illegal, invalid or unenforceable as applied under particular circumstances, such term, condition or provision shall not be deemed stricken from this Bylaw but rather shall be, to the greatest extent possible, deemed applicable only to such circumstances as will not support a finding of such illegality, invalidity or unenforceability.  The illegality, invalidity or unenforceability of any term, condition or provision of this Bylaw shall not affect the legality, validity or enforceability of any other term, condition or provision of this Bylaw.”

Attorney Jason Panos of Peabody, representing residents Michael and Heidi Tourkistas, who submitted Article 12 as a petition article, reviewed the proposal. He said he met with Mr. Dolan and Ms. Cademartori regarding the proposal to rezone the parcel at 5 Red Twig lane and 13,900 square feet of the parcel at 3 Red Twig Lane from Residence A to Limited Business. This property adjoins existing Limited Business property on Lynnfield Street near Goodwin Circle.

 

The proposal would call for one commercial building of about 4,000 square feet. Topography would shield the view of the building from the neighborhood. Any business with more than five employees would require a special permit from the Board of Appeals. There would be 42 parking spaces. He said he believes the traffic to be produced would be negligible, and said a business such as a bakery would draw from existing traffic. He said another possible use would be medical offices.

 

Attorney Panos said that the impact on Town services would be minimal and that the Town would realize additional tax revenue. Provision of utilities from the City of Lynn is under discussion, as well as provision of electrical service from National Grid. The proponents will meet with neighbors and a public hearing will be held by the Planning Board.

 

Selectman Barrett asked who would receive notice of the public hearing. While no notice is required for a rezoning article, the developer followed the usual zoning criteria of all abutters and abutters of abutters within 300n feet of the property. Selectman Barrett asked that the notice area be extended. Attorney Panos agreed to greater notice. He said he believes the development will be good for the Town.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen close fall town meeting warrant and include the 12 articles as enumerated and presented. Vote was unanimous.

 

Referral of warrant articles to the Planning Board

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen refer to the Planning Board for public hearing Articles 10 and 12. Vote was unanimous.

 

Review and recommendations on warrant articles

Chairman Dalton said he was ready to endorse passage of all warrant articles except articles 10 and 12, on which he wished to defer until the meeting prior to town meeting.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen recommend to voters the passage of warrant articles 1, 2, 3, 4, 5, 6, 7. 8, 9 and 11. Vote was unanimous.

 

Board of Selectmen updates

Healthy Lynnfield (Selectman Crawford): Peg Sallade has been hired as the Director of Prevention through funds provided to the Town in the state budget. She will start on November 1 and her activities will include applying for a federal grant. A Fitness Crawl at Market Street is planned with all proceeds going to Healthy Lynnfield.

 

Fire Chief Screening Committee (Chairman Dalton): Internal applications for the position of fire chief are due on October 2 and the committee will interview candidate son the following two evenings. About four applications are expected. The committee will recommend finalists to the Board, or recommend the search be broadened to external candidates.

 

Strategic Planning Committee (Chairman Dalton): The committee held its first meeting and chair Joseph Connell has undertaken significant preparation.

 

Town Administrator Update

Mr. Dolan gave brief updates on the following subjects: three-year budget projection; Perley Burrill site; Recreation Path proposal; school enrollment projections; Perry Avenue culvert project; hazardous material grant; Summer Street improvement project.

 

Chairman Dalton thanked the Department of Public Works for the cleanliness of the Middle School which he recently visited. He also mentioned that the new Lahey Heath building will have its grand opening tomorrow.

 

Public participation

Resident Patricia Campbell thanked the Fire Department for its work in assistant at the scene of the gas explosion in Andover. She asked that the Board expand the Emergency Management Planning Committee. She noted that in several leases of abandoned railroad beds for recreational paths, a clause would allow the MBTA to reclaim the rail line with two years’ notice. She said that Congressman Mouton has been discussion the need for a North-South rail line.

 

Use of Town Facilities

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the use of the Common by the Tree Committee for an event on Saturday, November 3. Vote was unanimous.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the use of the Common for the annual Veterans Day observance on Sunday, November 11. Vote was unanimous.

 

MOTION by Selectman Crawford, duly seconded by Selectman Barrett: I move that the Board of Selectmen approve the use of Town streets for the annual Rotary Turkey Trot on Sunday, November 25. Vote was unanimous.
