A regular meeting of the Planning Board was held on Wednesday April 12, 2017 at the Merritt Center 600 Market Street. Chairman Faria called the meeting to order at 7:00 PM and the meeting was left open to Monday April 24, 2017 at 5:59 PM in Room 110 at Lynnfield Middle School. Discussion ended at 7:10 PM.  Present: Chairman John Faria, Vice Chairman Heather P. Sievers, Clerk Charles B. Wills, and Brian R. Charville; Absent: Michael Sheehan

 

On a motion duly made and seconded four members present unanimously voted to recess the regular meeting, reopening after the public hearing

 

1.PUBLIC HEARING WARRANT ARTICLES

Clerk Charles B. Wills read the first line of the legal ad and Chairman Faria asked to entertain the waiving reading of the ad.  Motion by Sievers seconded by Charville the four members present unanimously vote to waive the reading of the entire legal ad.  Chairman Faria advised he will entertain a motion on Article 22 to amend the zoning bylaws by adding Section 7.7 “Temporary Moratorium on Marijuana Establishments and will not act on the remaining zoning bylaw articles.  Sievers stated the referendum questions and the Master Plan survey show the residents of the town are in favor of a moratorium.  Motion by Sievers seconded by Wills the four members present unanimously voted in favor of the article. Motion by Charville seconded by Wills the four members present unanimously voted to continue the public hearing to April 24, 2017 at 6:00 PM in room 110 at Lynnfield Middle School.

No action was taken on the following zoning bylaw articles;

Article 17 to delete the existing zoning bylaw, but not the map and substitute the document entitled “Re-Codified Zoning Bylaw.

Article 18 to amend the re-codified zoning bylaw section “Commencement of Construction or Operation” by changing the words “six month” to “twelve months”.

Article 19 to amend the re-codified zoning bylaw section regarding the “Lapse “ of “Special Permits” by changing the words “twenty-four months” to “thirty-six months” .

Article 20 to amend the Zoning bylaws by adding section “7.7 Marijuana Establishments Forbidden”.

Article 23 to amend the Zoning Bylaws Section 9.5 Planned Village Development District to allow a “Town Center Theater” by amending Sections: 9.5.4 Definitions; 9.5.6 Prohibited Uses and Activities; 9.5.7.4(b) Height in Traditional Neighborhood Village Sub-District; Table 9.5.8-1 Parking; 9.5.7.9 Dimensional and Other Requirements Total allowable non-residential uses.

 

The regular meeting then came out of recess.

 

2.RECOMMENDATIONS

Article 21 to amend the General Bylaws by adding as Chapter 170, Section 170-I “Marijuana Establishments Forbidden” Motion by Wills seconded by Sievers the four members present unanimously voted in favor.

Article 28 to authorize the board of Selectmen to execute a lease of up to 99 years with the Massachusetts Bay Transportation Authority. Chairman Faria stated he is wary of where the article came from.  He wants to see the motion on the article prior entertaining a recommendation.  Motion by Wills seconded by Sievers the four members present unanimously voted to continue the meeting to 5:59 PM on April 24, 2017 in room 110 at Lynnfield Middle School
